U.S. Department of Justice - Environmental and Natural Resource Division (ENRD) - Washington DC - June 26, 2019

The Environment and Natural Resources Division of the U.S. Department of Justice is seeking experienced litigators for its Environmental Enforcement Section in Washington, D.C.

The Environmental Enforcement Section brings civil enforcement cases on behalf of its client agencies, including the Environmental Protection Agency, Department of the Interior, Department of Agriculture, and Department of Defense. These cases seek control of pollution and cleanup of hazardous waste sites across the country. The statutes enforced by the Section include the Comprehensive Environmental Response, Compensation and Liability Act (also known as CERCLA or Superfund), RCRA, Clean Air Act, Clean Water Act, Safe Drinking Water Act and Oil Pollution Act, among others. In the hazardous waste context, cases are brought under the Superfund statute for the purpose of protecting the public health and ensuring that the responsible parties, rather than the public, bear the burden of paying for cleanup of hazardous waste sites. Cases brought under the regulatory statutes seek generally to require the defendants to come into compliance with the law through the imposition of injunctive relief and to discourage non-compliance by others through the recovery of civil penalties. The Section includes nearly half of the Division's attorneys.

Job Description: The breadth of the Section's practice is extensive and challenging. It includes cases of national scope, such as cases against multiple members of an identified industry, to obtain broad compliance with environmental laws. Characterized as complex litigation, the Section's cases typically involve significant factual and expert discovery and a substantial motions practice in the pre-trial stage. Many of the sections cases are resolved through judicial settlements involving negotiations over complex and technical injunctive relief requirements and payment of civil penalties. The position will allow the selected individuals to utilize their superior legal research, writing and oral advocacy skills in all aspects of case development, negotiation, motions practice and trial. The attorneys selected will be responsible for assuming a diverse case load brought under any of the statutes the Section enforces.

Qualifications: Applicants must possess a J.D. degree, be an active member of the bar (any jurisdiction), and be a U.S. citizen or National. Applicants should have a strong interest in federal litigation and/or trial work and a strong academic background. Judicial clerkship experience is valued and counts toward the post-JD legal experience. The ideal candidates will also possess a demonstrated interest in public service and/or environmental protection and enforcement.

Salary: Current salary and level of relevant experience will determine the appropriate salary level. The possible salary range is: GS-13 ($99,172 - $128,920), GS-14 ($117,191 - $152,352), and GS-15 ($137,849 - $166,500).

Southern District of Texas - Assistant Federal Public Defender - June 12, 2019

The Federal Public Defender, Southern District of Texas, is accepting applications for the position of Assistant Federal Public Defender to be stationed in the Houston office in the trial division. The federal defender organization operates under authority of the Criminal Justice Act, 18 U.S.C. § 3006A, to provide defense services in federal criminal cases and related matters by appointment from the court.

Requirements. An Assistant Federal Public Defender must be: (1) a graduate of an accredited law school, and admitted to practice in good standing before the highest court of a state; and (2) licensed to practice in the U.S. District Court for the Southern District of Texas by the time of entrance on duty. Three to five years trial experience. Spanish language proficiency is preferred for this position. Appointment is subject to a satisfactory background investigation including an FBI name and fingerprint check and an IRS tax check. Duties. The assistant federal public defender will represent clients charged with federal criminal offenses and clients involved in other matters covered under the Criminal Justice Act. The position requires travel for investigation, litigation, and training. Federal public defender attorneys may not engage in the private practice of law.

Selection Criteria. The successful applicant will have an established capacity or clearly demonstrated aptitude for excellence in criminal defense practice, a commitment to the representation of indigent accused persons, and a reputation for personal and professional integrity. Applicants must also possess the ability to communicate effectively with clients, witnesses, colleagues, staff, and court and agency personnel as part of their employment. Experience in handling federal criminal cases is preferred.

Salary and Benefits. The salary of an assistant federal public defender is commensurate with that of an assistant U.S. attorney with similar qualifications and experience. The position is in the excepted service and does not carry the tenure rights of the competitive Civil Service. The position does include regular Government employment benefits including health and life insurance, retirement, and the Thrift Savings Plan. Salary is payable only by Electronic Funds Transfer (direct deposit).

We regularly represent large, multinational financial institution clients in complex, billion-dollar financings, and are equally prepared to help regional banks, funds and other lending clients handle middle market, mission-critical deals efficiently and cost-effectively.

Qualified candidates will have 1-3 years of experience. Preferred candidates will have senior secured, asset-based, second lien, leveraged and/or syndicated finance experience, as well as strong academic credentials and law firm work experience.
